Part 2 - Validity conditions

Universal Grading Services BV's services and offerings are provided solely on the basis of our terms and conditions set forth below. The services and goods of Universal Grading Services BV include, among other things, the condition assessment (“Grading”/”Inspection”) of Trading Card Games, which are also carried out exclusively on the basis of the conditions stated here. The version valid at the time of the conclusion of the agreement is always decisive. Consumers within the meaning of these terms and conditions are natural persons or legal persons with whom business relations are entered into without a commercial or independent professional activity being attributed to them. Customers within the meaning of these terms and conditions are therefore both consumers and entrepreneurs.

Part 3 - Offer and conclusion of the agreement

Our offers are without obligation and non-binding. Our presentations of services and goods on the web or at other occasions such as fairs, conventions, etc. do not constitute an offer, but a non-binding invitation to the customer to make an offer to or order from Universal Grading Services BV. This also expressly includes the sending of articles by the customer with a view to grading by Universal Grading Services BV. Universal Grading Services BV reserves the right to accept offers submitted to Universal Grading Services BV. Designs, including dimensions, weights and other representations, are only descriptive and do not imply any guarantee of properties. We will confirm receipt of products sent by the customer, by means of whatsapp messages or via our social media channels. The acknowledgment of receipt does not constitute binding acceptance of the order, but only constitutes a declaration of acceptance if we expressly state this. Acceptance of the contract offer is made in writing and digitally. In case of immediate delivery, the acceptance of the agreement is tacitly confirmed; the written form is replaced by the attached invoice. We have the right to refuse to accept the order. Our salespeople are not authorized to make verbal side agreements.

Part 4 - Delivery and performance period

Dates and delivery terms are binding. The contractual return times specified by us must be observed by us. If unforeseen circumstances arise (personal or family), resulting in force majeure and a delay as a result, the customer will be contacted immediately to make this known.

Part 5 - Risk transfer

The risk of accidental loss and accidental deterioration of the goods and all services provided by Universal Grading Services BV, in the case of a purchase by mail order, also passes to the consumer when the goods and services are handed over to the consumer to be designated by the consumer. carrier (such as postal service, parcel services, railways, other logistics service providers, freight forwarders and the like). The transfer is the same if the customer is in default of acceptance.

Part 6 - Warranty

Universal Grading Services BV guarantees the proper execution of orders and assignments. For consumers, a warranty period of 24 months applies to goods and services. A guarantee period of 6 months applies to entrepreneurs. The sorts are all performed independently. It is ensured that every sorting is checked by at least 2 employees.

Part 7 - Payment

Invoices are payable by bank transfer, credit card payment, Ideal or Bancontact, unless agreed otherwise. Shipping costs are for the customer, both forward and back, unless expressly agreed otherwise. In cases where invoices are not paid after multiple requests and our contact moments are ignored, and the abandoned goods are not collected, they will be stored at a cost of one euro per day, per good. We keep these with a threshold of up to 500 euros for 3 months. Amounts above that are kept for 12 months. After these expired terms, we reserve the right to sell these goods in order to fulfill the unpaid performance.

Part 8 - Liability

Claims for damages against Universal Grading Services BV due to violation of legal or contractual obligations or for other reasons are not excluded. We are liable for any consequential damages. In the case of slightly negligent breach of duty, our liability and that of our vicarious agents will be limited to the foreseeable, contract-typical, direct average damage. We and our vicarious agents are not liable for slightly negligent breaches of duty that are not essential to the contract and the breach of which does not jeopardize the performance of the contract.

Part 9 - Data protection and right of objection

The data necessary for the transaction is stored by us and used in the context of processing the order.

Part 10 - Revocation

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, has taken or has taken possession of the goods. To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear statement (e.g. a letter by post, e-mail). To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.

Part 11 - Disputes in connection with an online purchase contract

In case of disputes in connection with an online purchase contract or an online service contract, the customer and Universal Grading Services BV have the option of using an online dispute resolution system of the EU Commission, accessible at: http://ec.europa . eu/consumers/odr

Part 12 - Right of use

The customer agrees that the objects sorted/inspected by Universal Grading Services BV can be displayed on the website of Universal Grading Services BV or other information media for the purpose of presenting the service of Universal Grading Services BV.

Part 13 - Final provision

Dutch law applies to these General Terms and Conditions. In the case of consumers who do not conclude their contract for professional or commercial purposes, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state where the consumer has his habitual residence. The provisions of the UN Sales Convention do not apply. If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the contract is our place of business. The same applies if the customer does not have general jurisdiction in the Netherlands or if the domicile or usual place of residence of the customer is unknown at the time the claim is made. Should individual provisions of the contract with the customer, including these General Terms and Conditions, be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The wholly or partially invalid provision will be replaced by a provision whose economic success approaches that of the invalid provision as closely as possible.
